Big rookie mistake and purchased some counterfeit Cohiba cigars. I did not figure out that they were fakes until recently. My question is, I still have them and are un- smoked, would I be out of line calling the smoke shop and complaining/asking for a return or refund?
The band is the black and gold design but in place of the checker board are white dots and instead of la habana, cuba it says dominican replublic...

They ARE Dominican Cohibas, but they are not the "Red Dots." I don't think they're legal, but I have not kept up with the recent proceedings on all of that. I have seen many, many of these "alternative" Cohiba Dominicans around over the years, but I was under the impression that they were no longer made.
My dad bought a couple down in Florida a few years back. I explained to him what they were and then mentioned that fake Cubans oftentimes have tobacco scraps from off of the floor replete with rat hair. From that day forward, my dad's cigars became known as "rat hairs." Not sure he smoked many more. I bought him some Davidoffs and he liked those better anyway.
Bad form to call people names when it is apparent that you don't have much idea of what you are talking about.

There is one Cohiba cigar that the U.S. courts have ruled can be legally sold in the United States, and that is made by General Cigar. It's the one known as the red-dot Cohiba for its red dot on the band. The band doesn't look like a Cuban Cohiba cigar band.

There are legitimate DR Cohibas, black band with red dot, legal for sale in the US.
There are counterfit Cohibas made in the DR with fake bands that resemble, I use the term loosly, the authentic Cuban products.
Cuban Cohibas sold in the US shuld be considered 100% fake and are illegaly imported from Cuba, The Dominican Republic or Mexico for obvious reasons. The real cost of the fakes are roughly 25 dollars a box and they are sold to uneducated consumers for 25 to 35 dollars each.
I would take them back and confront the shop owner. Good luck.

Get them out of your humidor ASAP -- I've seen these things before, usually with beetle holes because they don't go through any kind of fumigation/freezing/etc
so far no beetle holes, I think I may just pawn them off on some friends. I think I may call the shop where they were purchased and see what they have to say.
Just to be clear they are not the dominican cohiba w/ the black/white and red dot. The band on these bad boys are yellow w/ black dots instead of the check pattern, and it said Dominican instead of La Habana, Cuba.
