In Alabama early this morning there was a home invasion in a upscale neighborhood. A man broke into the house waking up a couple and held them at gun point. The home invader tied the man up and at gun point made the woman help him gather up some jewlery and electronics. The man was able to untie himself and retrieve his handgun. When the home invader came back to the room whith the mans wife there was a shootout and the home invader was killed. No charges were filed against the home owner and the woman that was waiting outside in the getaway car was arrested and charged with murder.

This is OUTSTANDING!!!!!!!!!! Moral of this story it is good to have a loaded firearm in the house and don't invade homes in Alabama.

Yeah...and now all those lawyers with 20/20 hindsight and bags full of perfect scenarios will be persecuting the victims in the name of the felon's family.

I don't believe it this is one of those urban legends...here is how you can tell...there is no such thing as an "upscale neighborhood" in Alabama!

I would like to apologize for my above comments. I should not disparage a people just because of their state of residence. Also, I forgot that in Alabama "upscale neighborhood" means "double wide trailer park."

BinDer,

If what you say is true which it is NOT then I could say that the only thing in New Jersey especialy South Jersey are low life street thugs.

Whats wrong with a double wide!!!! I live in a double wide. I bought 17 acres in the country with a quarter mile of river front property. There was not a house on the property and I needed to move before I could build a house. At the time I was married to a doctor and I bet we made more money than you do!!!!!! Now that I am divorced I spend my money on the land and will build a house in 5 years when the land is paid for.

My father is a retired Doctor and I grew up in an an upper class neighborhood in a 9000 sq ft house. I bet you dont live in a house even close to some of the houses I have lived in. Have you ever even been to Alabama?? I have been th Jersey and you can keep it....

Binder,

I live just outside Birmingham and recently had my home appraised in connection with refinancing my mortgage. I guess the appriaser just misplaced the decimal point when he came back with $450,000.

Raven - Does my heart good to hear stories like this. The home invader got what he deserves.

Binder - That was just a stupid comment - both of them.

BinDer,

I bet if this had happened in Jersey the police would have arrested the home owners for having a weapon and for murdering this poor home invader. Then the home invaders family would own the house after they won their wrongful death law suit. Yes it sounds like you live in a great place.

raven et. al,

Not defending anyone, but when I first read Binder's remarks, I took them as his way of trying to be sarcastically funny...you know, raggin' on the south. I didn't really take offense. Maybe I was wrong.

Also, one thing I don't understand in the story. How can the lady driving the get away car be charged with murder? I can see her as an accomplice to the attemped burglary, but it was her burglar/partner who got killed. Seems like the wrong charge to me. Perhaps some of you law enforcement folks could chime in on that one? Not trying to defend her, either, just hate to see her walk because of the wrong charge.

Just my .02, which could be more than it's worth.

A good cigar and a good drink on the back deck by the lake...if that doesn't make you relax, nothing will!

any criminal involvement that leads to a homicide makes the party resposible for the actions that lead to the chain of events which
in this case "her driving to and being involved in a home invasion which lead to a homicide". Her actions lead to the death of her partner. therefore she is responisble for his death.

People aren't smoking cigars to be trendy, cool or stylish. They're smoking cigars because they like them. Because they enjoy the experience. Because for about $5 they can spend an hour sampling one of life's greatest luxuries.

Actually, the driver will be charged with what's called "felony" murder which essentially says that anyone involved in the commission of a felony is guilty of murder if the felony results in anyone's death. Thus, the driver (who was involved in the felony of breaking and entering) is liable for the murder of her co-conspirator even though she was not involved in his death. Actually, since the conspiracy to break into the house was itself a felony, she would have been liable for the murder even if she had stayed home.
