An LCdH is not exactly a licensed carrier of Habanos' products; it is the official outlet.
Your question is like asking if a McD's restaurant got "caught" selling fake hamburgers. Each franchise receives its stock directly; it's not as if the shopkeepers order their cigars from several distributors.
Now, if you're asking about a private cigar shop, not an actual La Casa, whose owner buys from Havana House or Altadis or whatever official distributor as well as others, who might inadvertently or otherwise buy some counterfeits to sell in his shop....
Well, too much has been written about this already.
Proprietors of privately owned smoke shops are infrequently inspected by reps from that country's official, exclusive Habanos distribution house. If caught with fakes on their shelves, they lose their contract and their tobacco dealership license. If all they sell is tobacco, this will result in having their business shut down, and is therefore too risky. If they are a larger store that can survive without that tiny cabinet of fake cigars in the corner, they might take that risk.
I'd be surprised if any LCDH DIDN'T engage in such practices. And that goes for every one. But what do I know.
LCDH is a licensed name...but not from Habanos S.A.

This is not a true statement. What will happen is that arrangements will be made, if they were not made in advance, for the 'inspectors' to sign off on the store...and everyone walks away happy.

I just love all this surmise under the color of authority...what will happen, the nature of the relationship between Habanos S.A. and LCDH...it's all conjecture that should be regarded as such (or disregarded as the case may be).

If "found guilty" what would happen to that particular LCDH?
The answer is YES. They would be investigated, as they are only allowed to buy the cigars through Habanos S.A. or one their official distributors as set forth in the franchise agreement. They would then lose their franchise if found guilty of selling fakes.
As it is unlikely for a LCdH of selling fakes it is not as simple as the McD's reference, that would be assuming EVERYONE abides by the rules. As they always say you are guarenteed 99.999% of getting REAL Cuban cigars when you purchase from there...there is always that .001% you have to worry about.
